Records include general administration files, subject files regarding congressional matters, education, foreign/international relations, organizations, social security, states, taxation, and tenure of church property, and miscellaneous publications and proceedings. There are also some personal correspondence files for directors William F. Montavon, Eugene Butler, and William Consedine.

Historical Note
Originally known as the Department of Laws and Legislation, it was established in December of 1919 as one of the five founding departments of the National Catholic Welfare Council. The name has been changed twice, in April of 1926 it became the Legal Department, and in November of 1966 it became the Office of the General Counsel, the name that it still bears. This department/office has worked to maintain a record of proposed and enacted federal legislation; to exchange legal and legislative information with and to advise the departments and committees of the NCWC/USCC and interested organizations and individuals; to confer and exchange judicial, legal, legislative, and administrative information with state Catholic conferences, diocesan attorneys, and other national, regional, and local Catholic entities and organizations; to serve the dioceses and Catholic agencies by means of extensive legal research, advice regarding specific legal issues, study of government regulations, and by attending to administrative matters before federal authorities. In addition, it has served to represent the NCWC/USCC in litigation and has published scholarly works and conducted public speaking on issues of law and policy affecting the Roman Catholic Church. Noted directors include William F. Montavon (See also: Papers of William Frederick Montavon), 1925-1951, Eugene J. Butler, 1951-1956, William R. Consedine, 1956-1974.
Since its inception, much of the work of the department/office has remained consistent even as the nuances of the legal aspects themselves changed. Among its most frequent areas of concern over the decades include educational reform, tax policy, civil rights, immigration, and marital legislation. From the very beginning, the department/office has been at the forefront of legislative and legal battles over the role of parochial schools in the United States and their relations with both state and federal governments. Throughout the 1920s and into the 1930s, the department worked closely in informing and providing support to organizations opposed to the creation of a federal education department, through the Sterling-Towner bill and later Federal Education bill. During this period, it worked to prevent governmental restrictions on parochial schools, such as in the case of the 1922 Oregon Compulsory Education Act, as well as seeking to extend governmental recognition and support for Catholic education through auxiliary and financial support programs. These issues of battling restrictions and seeking governmental recognition would continue to be major themes throughout the department's work well into the 1970's.
Beginning in 1925 with the directorship of William F. Montavon, the department expanded to include work on the behalf of Catholics abroad and the vulnerable domestically. With frequent reports, as well Montavon's own personal engagement, the department entered into the complicated legal matters involved in the Mexican Cristero War (1926-1929) and its aftermath throughout the 1930s. This period also witnessed the department's involvement in the legal advising and reporting on the status of religious legislation and freedoms throughout the various Latin American republics, Haiti, the Philippines, and Spain (The last of which was especially prominent during the 1936-1939 Spanish Civil War).
While never abandoning its work on education, the department also worked on domestic social policies, including the growing number of eugenics, sterilization, and birth control bills emerging in state legislatures across the country throughout the interwar period. Simultaneously, Montavon led efforts to oppose the enactment of a national quota system as specified in the Immigration Act of 1924. (A theme that would reoccur throughout the department's history after World War II.) Beginning with the passage of the Tariff Act of 1921 and well past the passage of the Tax Reform Act of 1969, the department kept a keen watch on taxation issues that impacted religious institutions and offered tax advice to Catholic organizations, clergy, and dioceses.
By the 1930s, with the Great Depression ongoing, the department kept its associates abreast of developments with governmental relief efforts and the changing role of the federal government in the economic and domestic spheres. Of particular import to the department was the New Deal legislation that began to fundamentally impact both the social mission and employer status of the Church. In addition to supporting workforce relief efforts, the department closely followed developments in Social Security legislation and how it impacted clergy and Church staff. As the clouds of war gathered in the last half of the decade, the topic of Selective Service became of increasing importance to the NCWC as the draft status of seminarians was left in doubt. Through a variety of lobbying efforts, the department worked to better define the eligibility of those in formation, as well as working to spread knowledge about the need for relief in war-torn parts of the globe.
In the new domestic and international order that emerged in the aftermath of the war, the department witnessed new concerns and the rehashing of old battles over the role of Church and state in education, the domicile, and the rights of individual citizens. Civil rights legislation, divorce laws, and court battles over the precise relation between church and state dominated the work of the department throughout the 1950s and into the 1960s. As was the case in the previous decades, education became the main battleground over the precise relationship between religion and government. Three cases were of prominence during this period (McCollum v. Board of Education 1948, Zellers v. Huff 1951, and Zorach v. Clauson 1952).
By the time of the 1950s, the department was still deeply involved in the educational sphere. With the passage of both the National Defense Education Act of 1958 and the Elementary and Secondary Education Act (ESEA) in 1965, the question of federal funding of education became increasingly prominent in the work of the department. Lobbying and legislative efforts were made to include within the scope of the bill funding for parochial schools. At the same time, continuing efforts to guarantee or expand auxiliary support (bus services, free textbooks, lunch programs) from the state to parochial schools continued.
The continuing work of the Civil Rights movement also came to inform the work of the department. Cases stretching from Brown v. Board of Education to Loving v. Virginia demonstrate the organization's careful watching of and advocacy for civil rights reforms. Taxation seems to be the major concern of the Office during the 1970s, particularly as it relates to tax reform and unemployment compensation.
Scope and Contents
The first series is Chronological Correspondence, 1957, 1975, in box 1. This is clearly a small surviving portion of a much larger series, with copies of outgoing office correspondence on fragile onion skin paper.
The second series is Administrative Files, 1922-1981, in boxes 1-18. There are two subseries. The first is General Correspondence and Subject files, 1922-1980, in boxes 1-15, with material relating to NCWC (and later USCC) departments, offices, and affiliates. This includes much of a routine nature relating to insurance, invoices, and payroll as well as specific entities such as the Campaign for Human Development (CHS), Catholic Committee on Refugees, and the Confraternity of Christian Doctrine (CCD). The second subseries is Directors Correspondence, 1929-1966, in boxes 16-18, with material from various directors including William F. Montavon, Eugene Butler, William Consedine, and George F. Reed.
The third and largest series is General Correspondence and Subject Files, 1921-1981, in boxes 19-118. This contains material focusing beyond the bishop's conference and is divided into two subseries. The first is General Correspondence, 1921-1978, in boxes 19-33, and organized alphabetically. Topics include birth control, child welfare, church and state, health and hospitals, housing, immigration, marriage and divorce, obscenity, priorities, and religious matters. Priorites is further subdivided into matters relating to churches, convents, nursing homes, and especially schools. The second subseries is Subject Files, 1921-1981, in boxes 34-118. This latter subseries has voluminous files concentrated on certain specific and major subjects like congressional matters in boxes 36-43, education in boxes 44-64, international relations in boxes 65-81, organizations in boxes 82-91, social security in boxes 92-98, states in boxes 99-102, taxation in boxes 103-116, and tenure of church property in boxes 117-118.
The fourth and last is also the smallest series, Miscellaneous Publications and Proceedings, 1929-1964, in boxes 119-120. These include a hodge-podge of departmental publications as well as from other parts of the NCWC as well as materials from private, legal, and governmental organizations, especially from the United States Congress.
